These General Terms and Conditions (Allgemeine Geschäftsbedingungen, AGB) govern the purchase of the book Vernacular Branding for customers in Germany, fulfilled from Germany.

§1. Scope & seller

These terms apply to all orders placed through the “Buy in Germany” route of this website. The seller and contracting party is Kaushambi Mate, Marshallstraße 32, 48291 Telgte, Germany (the “Seller”). The Seller operates as a small business under § 19 UStG. These terms apply to consumers and to business customers.

§2. Product

The product offered is the premium hardcover edition of Vernacular Branding: Reading Identity through Design and Visibility, subject to availability of the limited inventory held in Germany.

§3. Formation of contract

The presentation of the product on the website does not constitute a binding offer. By proceeding to the Stripe checkout and completing payment, you make a binding offer to purchase. The contract is concluded when the Seller confirms the order or dispatches the book.

§4. Prices & VAT

In accordance with the small business regulation under § 19 UStG, no VAT is charged or itemised on the invoice.

§5. Payment

Payment is made through Stripe (cards and supported methods). PayPal is available on request by contacting contact@vernacularbranding.in. For alternative arrangements, please contact the Seller before ordering.

§6. Shipping & delivery

Orders are securely packaged and dispatched within 2–3 working days of payment confirmation. Delivery transit is typically 5–10 working days depending on the destination country. Tracking details are provided upon shipment. Shipping is offered within Germany as supported at checkout.

§7. Right of withdrawal (Widerrufsrecht)

Consumers have a statutory right of withdrawal. The statutory withdrawal instruction is reproduced below in German (the legally authoritative version), followed by an English courtesy translation.

Widerrufsbelehrung

Widerrufsrecht. Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen haben bzw. hat.

Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Kaushambi Mate, Marshallstraße 32, 48291 Telgte, Deutschland, E-Mail: contact@vernacularbranding.in) mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief oder eine E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs. Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet. Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist.

Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an uns zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden. Sie tragen die unmittelbaren Kosten der Rücksendung der Waren. Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.

English translation (courtesy). You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you (or a third party named by you, other than the carrier) take possession of the goods. To exercise the right of withdrawal, you must inform us (Kaushambi Mate, Marshallstraße 32, 48291 Telgte, Germany; contact@vernacularbranding.in) of your decision by a clear statement. If you withdraw, we will reimburse all payments received from you, including standard delivery costs, without undue delay and within fourteen days of receiving your notice, using the same means of payment. We may withhold reimbursement until we have received the goods back or you have supplied evidence of return. You must send back the goods within fourteen days. You bear the direct cost of returning the goods. You are liable for any diminished value of the goods only if it results from handling beyond what is necessary to establish their nature, characteristics and functioning.

§8. Retention of title

The goods remain the property of the Seller until full payment has been received.

§9. Statutory warranty

The statutory warranty rights for defects apply. If the delivered book is defective, you are entitled to the statutory remedies.

§10. Liability

The Seller is liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence, the Seller is liable only for breach of an essential contractual obligation, limited to the foreseeable, typical damage. Any further liability is excluded to the extent permitted by law.

§11. Intellectual property

The book and its contents are protected by copyright. Purchase of a copy does not transfer any rights of reproduction, distribution or other exploitation.

§12. Governing law & jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence. Where a place of jurisdiction may lawfully be agreed (in particular with merchants or customers without a general place of jurisdiction in Germany), the courts competent for the Seller’s registered seat in Telgte shall have jurisdiction. For consumers, the statutory rules on jurisdiction apply.

§13. Severability

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
